Are the suspended employees eligible for new pay sacle?

Delhi High Court on Monday ruled that a government employee who was suspended would be entitled to the enhanced pay scales recommended by a new pay commission.
Dismissing the central government’s contention that a suspended employee would not be entitled to the recommendations of a new pay commission, a bench comprising Justices Madan B. Lokur and J.R. Midha said such an officer was entitled to enhanced subsistence allowance.
The court’s ruling came in connection with a case in which the Ministry of Commerce and Industry had challenged an order of the Central Administrative Tribunal (CAT), which held that a suspended employee was entitled to higher allowances based on the recommendations of the Fifth Pay Commission.
The Department of Industrial Policy and Promotion under the Ministry of Commerce and Industry had put R.K. Chopra under suspension, during which period the Fifth Pay Commission report was implemented.
The government challenged the CAT order, which had enhanced the allowances of Chopra during his suspension period.

Where is the Pay Commission Report now?

Sources said a wait for one more week may bring Sixth Pay Commission Report in Black and White as Men in charge are making the 6CPC report finer which was earlier approved by cabinet broadly a week back.
One of the senior level officers who are finalising the 6CPC implementation told that after the approval by the Cabinet, the report has been handed over to DOPT (Department of Personnel and Training) for making it executable. The Official has also told that the following areas are being concentrated by DOPT now before implementing the report.
· Pay Fixations relating to Group D cadre as the same is to be retained as per Cabinet's approval against the 6CPC recommendations otherwise.
· Workability of Uniform Date of increment (during every July of the year) recommended by 6CPC.Possibility of reducing HRA to higher level Officers stationed at A1 Cities, as 30% HRA on the Pay of certain high level cadres exceeds Market Rent prevails at Metropoliton Cities.
· Adjustments in Grade Pays relating to certain Pay scales of Group C and Group B which were merged by Sixth Pay Commission recommendations.
· Modility in the Grant of Personal Pay in the background of fixed annual increment which was the basis for payment of Personal Pay so far has been replaced with percentage based annual increment.

Recent News of 6 CPC

After much wait it’s time for New Pay and Arrears Calculators based on Pay Commission report approved by Cabinet.
Just enter your basic pay as on 1.01.06, new grade pay as per pay commission recommendations, New HRA rate, Old HRA rate, Increment month, New TA amount and the amount of increment in the fields specified.
The Calculator meant for Pay Band up to PB-2, would take into account the revised Merger Ratio of 1.86 times of Basic Pay as on 1.1.06 and the annual increment of 3% (during every July). In respect of the Calculator meant for Pay Band above PB-3 and above, since there is no uniformity in the merger ratio (unlike in the case in respect of upto PB-2 which had uniform merger ratio of 1.74 times of BP earlier), the revised pay bands could not be calculated without the release of pay band details by the Govt for certain pay scales. We assure to sort out this issue once the entire pay band details are released by the Govt. The revised calculator for PB-3 and above, has been incorporated with the changes such as annual increment of 3%, and application of merger ratio of 1.86 times of basic pay as on 1.1.2006 for most of the scales (where 1.74 times applied in 6CPC recommendations). We have taken the pay bands recommended by 6CPC as such in respect of scales which were not fixed based on 1.74 merger ratio by 6cpc in their recommendations.

The positive and negative aspects of pay commission report as approved by cabinet

POSITIVE THINGS:
1. Date of Effect has been accepted as 1.1.2006.
2. Rate of increment is raised to 3%.
3. Staff Side Demand for 3 Financial Up-gradations is accepted and a 3 ACP Scheme for provision of financial upgradations on completion of 10, 20 and 30 years of service for all Civilian Employees is announced. [For Postal Employees, after study of the full orders, we have to opt for the ACP Scheme by switching over from the TBOP/BCR Scheme].


NEGATIVE ASPECTS:
1. Arrears will not be paid in one lump-sum. Only 40% arrears will be paid in the current financial year and the balance 60% would be paid in the 2009-2010 financial year only.
2. Even the demand for 3.5% annual increment is not accepted.
3. The negative modification made in the ACP Scheme for denying financial upgradation beyond the next grade pay stage is accepted while granting one more financial up-gradation under modified 3 ACP Scheme.
4. Need Based Minimum Wage for a Group D worked out by the Staff Side under the 15th ILC norms for Rs.9700/- is not accepted. Even the 7400/- Minimum Wage under the 5th CPC's NNP Formula for the Group D is rejected. Instead only Rs.7000/- announced as the minimum wagesfor a Group C. This is total injustice.
5. The Government says the minimum gross salary will be more than 10,000 per month. But the fact is that only the Group C would get this 10,000 minimum including HRA and other allowances. In Public Sector like LIC the gross salary of a Group D is at present more than 9000/- and with the next wage agreement round the corner for them, the Group D in PSU would go upto more than 12000- . But our Group C would be drawing much less than the Group D of the PSU.
6. The glaring discrimination perpetrated by the Pay Commission by granting a minimum of 41% fixation benefit to a maximum of 180% for the higher officers and recommending only 12% to 38% fixation benefit for the Group C and D employees has not been removed. The major demand of Staff Side for granting a uniform fixation benefit at the rate of 41% by providing for a 2.625 times fixation benefit is rejected. Only a 1.86 times fixation benefit is accepted.
7. The acceptance of the recommendation for abolition of Group D by announcing that except the Peons in Ministerial Offices and the Porters of Railway Department, there will be no Group D in future is a big blow. The pay scale of Group D has not been revised. The 6th CPC recommendation that non matriculate Gr D would be placed at Rs 4740/- without Grade Pay and allowances including DA has been accepted by Government in an implied manner.
8. Unless it is clarified that in the Department of Posts, the promotion for GDS will continue to be made against the upgraded Group D instead of Group D as at present, the promotional avenues of three lakhs of GDS would be hit in a most adverse manner.
9. The change of Base year for DA from 1982 to 2001 would affect the quantum of DA payable to us. The move to introduce separate Consumer Price Index for Government employees is fraught with dangers for employers.

In supersession of previous orders contained in Notification No. GSR
No. 643 (E) dated 23rd October 1991, GSR No. 259(E) dated 5th March 1993
and GSR No. 46(E) dated 22nd January 1999 and office orders 1-4/89-R dated
24.10.1991 and 1-15/97-Rates dated 25.1.1999, the Central Government has
decided to revise the tariff for certain foreign postage items with effect from
1st September 2008. The details of revised tariffs are given in the ‘annexure’
to this letter.
2. Suitable instructions may be issued to all subordinate units under
your administrative control to note the above changes in foreign postal tariff
and to ensure that these are implemented from 1st September 2008.
3. Adequate publicity through Newspapers etc. may also be made.
4. A copy of the Gazette Notification amending the relevant rules in
Indian Post Office Rules, 1933, will be sent in due course.
5. It may be noted that for postal articles cleared on 1.9.2008 from letter
boxes in the first clearance existing rate of postage will apply.
6. Hindi version of the order will be sent shortly. Kindly acknowledge

New DA calculation after implementaion of sixth CPC.The 6 CPC has given an Errata in its website for calculation of Dearness Allowance with effect from 01.01.2006 as follows: " The reference base for calculation of DA w.e.f. 01.01.2006 will be the 12 monthly average index of 536 as per AICPI(IW), 1982 series. Government Employees Became Rich



The official release of the cabinet decision follows............. The Union Cabinet today gave its approval for implementation of the recommendations of the Sixth Central Pay Commission. The revised pay scales will come into effect from 1/1/2006 and revised rates of allowances from 1/9/2008. The Cabinet has also decided that arrears will be paid in cash in two instalments – first instalment of 40% during the current year (2008-09) and the remaining 60% in the next financial year (2009-10).2. The Cabinet has broadly accepted the recommendations of Sixth CPC with some modifications in the wake of representations received from various sections/Associations of Central Government employees. The new system of four Pay Bands with 20 Grade Pays recommended by the Commission has been accepted with some minor modifications.3. The minimum Basic Pay for a Government servant has been increased to Rs.7000 from Rs.6660 recommended by the Sixth CPC. Consequently, the total emoluments of an employee at the lowest level will exceed Rs.10,000 p.m., including allowances.4. The other highlights of the Cabinet decision covering all Government employees including the Defence Forces are:-(i) Enhancement in the fitment in revised pay bands, which was recommended by the Sixth CPC to be based on multiplication factor of 1.74 to 1.86. This would result in increased emoluments for Government employees.(ii) Increase in the rate of annual increment from 2.5% to 3%.(iii) Removal of Campus restriction for grant of Transport Allowance.(iv) Increase in Transport Allowance at the lowest level to Rs.600 (from Rs.400 in A-1/A class cities recommended by the Sixth CPC) and Rs.400 (from Rs.300 in other cities recommended by the Sixth CPC).(v) At least three promotions have been assured for all Defence Forces’ personnel and civilian employees under the modified Assured Career Progression (ACP) Scheme. While the civilians would get it after 10, 20 and 30 years of service, the Defence Forces Jawans would get ACP in 8, 16 and 24 years.5. For the Armed Forces personnel, the Commission, for the first time recommended a Military Service Pay (MSP). The Cabinet has increased the rate of MSP for PBORs to Rs.2000 from Rs.1000 recommended by the Commission. The Officers of the Defence Forces would get an MSP of Rs.6000 over and above their Pay.6. The middle level officers of the Defence Forces namely Colonels and Brigadiers have been placed in the highest Pay Band of PB-4.7. Senior Lt. Generals overlooked for promotion as Army Commanders due to lack of residual service would now get the grade of Army Commander (Secretary’s grade). In the case of existing Major Generals/Lt. Generals, MSP will be taken into account notionally for fixation of pay on 1/1/2006.8. As replacement of the pay scale of Rs.24050-26000, a separate pay scale has been carved for DGPs, PCCFs, GM (Railways), members of the Boards of Income Tax, Customs & Central Excise, Postal and Ordnance Factories, among others, who were in this pre-revised scale. This would take them to the level of Rs.80000 in two years as against three years in the pre-revised scale.9. Further, the IPS Pay Rules and the Indian Forest Service Pay Rules will be appropriately modified to provide in each State cadre one post of DGP and one post of PCCF at the apex level of Rs.80000 for heading their respective Forces.10. Middle level Police and Civilian officers i.e. DIGs, Conservator of Forests, Scientists E & F, Superintending Engineers, Directors, Additional Commissioners of Income Tax and Central Excise and posts in equivalent grades have also been placed in PB-4.11. Other salient decisions taken by the Cabinet are:-(i) The lower limits of Disability Pension for Defence personnel to be doubled from Rs.1550 to Rs.3100. War Disability Pension to be granted at 60%;(ii) The rates of Special Forces Allowance for Army and Air Force to be equated with navy’s Marine Commando Allowance;(iii) For the officers of Central Para Military Forces, all the posts of Additional DIG upgraded to DIG level by the Pay Commission to continue to be manned by the cadre officers of CPMFs;(iv) For the Railway employees who are in receipt of Running Allowance, this allowance will be taken into account while fixing their pay in revised pay bands;(v) Government has continued the present position of granting Group A scale to Group B officers after 4 years of service and these officers would be placed in PB-3 instead of PB-2 recommended by the Sixth CPC. This would benefit Group B officers of the Railways, Accounts Services, CSS, CSSS and DANICS & DANIPS.(vi) For Doctors, the Cabinet has approved promotions under the Dynamic ACP Scheme upto Senior Administrative Grade (Joint Secretary level) for Doctors with 20 years of service. Counting of Dearness Allowance (DA) on Non-Practicing Allowance (NPA) as on 01.01.2006 for fixing their pay in revised pay bands has also been approved;(vii) For the scientists, continuation of the existing system of grant of Special Pay of Rs.2000 p.m. to Scientists G on promotion and doubling of the amount to Rs.4000 p.m. in Departments of Space and Atomic Energy and Defence Research & Development Organisation (DRDO) has been recommended.12. The financial implications in 2008-09 on account of the implementation of the recommendations of the Sixth Central Pay Commission as modified by the Cabinet will be around Rs.15700 crore on the Central Budget and Rs.6400 crore on the Railway Budget.

Full Pension at 20 years of service

In a development that could well encourage more civil servants and armed forces personnel to opt for careers in the private sector, the government has decided to grant full pension benefits to all government employees who leave after 20 years in service, against the current 33 years.The Union Cabinet has accepted this proposal, along with other recommendations of the Sixth Pay Commission on pension benefits for the estimated 3.84 million central government pensioners at a meeting here on Thursday. Experts said the reduction in the number of years of service to 20 years to earn full pension benefit was a liberal move and would end stagnation in government service.Government officials told Business Standard that several other recommendations have also been accepted. These include raising the gratuity limit to Rs 10 lakh, higher pension for octogenarians, exclusion of earned leave encashed while in service from the overall limit, clubbing of earned leave and half-day pay leave for encashment. Pensioners to get 40% raise, more gains for octogenarians.Octogenarians will now be paid an additional 20 per cent of their basic pension, while those aged 85 will get 30 per cent more, rising to 100 per cent additional pension for centurions.Officials said the final award for pensioners accepted by the government implied that central government pensioners would receive an overall increase of 40 per cent in pension. As a result the total estimated pension liability of nearly Rs 29,900 crore of the central government will go up by nearly Rs 1,400 crore annually.Based on the Invest India Incomes and Savings Survey, 2007, it is estimated that 5.3 per cent central government employees (170,000) are likely to retire in the two years till 2009-10.Another proposal to change the commutation formula and outsource the process to public sector banks, which would have saved the government Rs 2,344 crore annually, is also likely to have been accepted. If implemented, the government will bear only a notional subsidy on account of the interest payable to banks by employees who decide to commute a part of their pension, against the entire amount plus interest.The central government had estimated 3,321,210 employees (excluding defence personnel) on its rolls in 2007, with the number projected to go up marginally to 3,329,682 in 2008.
